These Terms govern your access to and use of the Yarra Digital service. If you agree to these Terms, and wish to use the Service, please click on the "Submit" button. This will constitute a binding agreement between you and Yarra Digital. Your access to and use of the Service are expressly conditioned on your compliance with these Terms. Note that any violation of these Terms may result in termination of our Service to you.

Yarra Digital reserves the right to change these Terms anytime. Please refer to this site periodically for any changes. By continuing to access or use the Service after Yarra Digital makes any such changes, you agree to be bound by any such revised Terms.

   1. Your Submissions

      You will submit certain material to Yarra Digital, including without limitation, photographic images, as part of your use of the Service ("Submissions").

      By submitting images(digitally online or physically mail-in), you authorize Yarra Digital to perform any work on the images. You certify that you are the copyright holder of the images or you are submitting on behalf of the copyright holder of the images.

      Under these Terms, you agree that you will NOT post, place or transmit any of the following material or obtain any such material using the Service:
         1. Any threatening, defamatory, abusive, obscene, pornographic, inappropriate or profane material or any other material that could give rise to any civil or criminal liability under applicable law.
         2. Any material that could infringe rights of privacy, publicity, copyrights or other intellectual property rights without the permission of the owner of these rights and the persons (or their parents or legal guardians, where applicable) who are shown in the material if applicable;
         3. Any material sent from an anonymous or false address;
         4. Any material that promotes bigotry, racism, hatred or harm against any individual or group;
         5. Any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

      While Yarra Digital is not responsible for, and does not review or comment on the content of Submissions provided by Yarra Digital users, Yarra Digital reserves the right in its discretion to (i) delete, move or edit Submissions that it, in its sole discretion, deems abusive, defamatory, obscene, inappropriate, or in violation of copyright or trademark laws, or otherwise unacceptable, or (ii) take any other action that Yarra Digital deems necessary relating to use or misuse of the Service. Yarra Digital may request confirmation of the copyright or trademark ownership from the submitter. If Yarra Digital does not receive any such confirmation or if there are continued claims of copyright or trademark infringement relating to certain Submissions, Yarra Digital reserves the right to (i) suspend the shipping of an order relating to the Submission in question, and/or (ii) share the submitter's account information with governmental organizations, law enforcement authorities or other third parties. If you, as a submitter, dispute any copyright or trademark infringement claims, we will share with you the contact information of any party claiming any such infringement. In the event of any such dispute, Yarra Digital reserves the right to suspend the display, viewing or sharing of any Submissions until the issue has been resolved. You hereby grant to Yarra Digital a non-exclusive, royalty-free license to use, publish, copy, modify, transmit, display and distribute your Submissions for the sole purpose of delivering the Service. In addition, you warrant that all moral rights in any Submissions and uploaded materials have been waived and do hereby waiver any such moral rights.

      Your physical or electronic sharing of your images constitutes permission for reprinting by the recipient. Yarra Digital will not be liable for the content of any Submission and, as further set forth herein, expressly and fully disclaims all liability relating thereto.
  
   2. Copyright Notice

      Yarra Digital is committed to protecting photographers' copyrights and expects users of the Service to do the same. Each image submitter is required by Australia law to own the right to, or to obtain permission to, use any image before the image is uploaded or printed at Yarra Digital. At Yarra Digital's discretion and in appropriate circumstances, Yarra Digital may terminate the accounts of users or prevent access to the Service by users who infringe the intellectual property rights of others. If you believe that your work has been copied in a way that infringes your copyrights, please contact us and provide all relevant details.

      If you explicitly agree to share your pictures with us, you grant us the right to lawfully use your pictures for demonstrations, promotions and advertisements etc.

   3. Privacy

      Yarra Digital is committed to protecting all customers' privacy. For more details, please refer to the Privacy Policy.

      Your email privacy - we will not send you any junk mails; We will not share your email with any third parties; By signing up with us, you agree to let us contact you about your requests/orders.

      If you explicitly agree to share your experience and pictures with us, your comments and pictures might be used for our promotional practice.

   4. Others

      We may assign our rights and responsibilities hereunder without notice to you.
      Unless otherwise specified herein, these Terms and the Privacy Policy constitute the entire agreement between you and Yarra Digital and its affiliates with respect to this Site and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and Yarra Digital with respect to this Site. If any part of these Terms or the Privacy Policy is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

 

At Yarra Digital, your personal information is highly respected and 100% protected except where prohibited by law.

    * There are no circumstances, under which we would store a customer's banking or credit card information.
    * Our website does not use "cookie" technology. "Cookies" are encrypted strings of text that a website stores on a user's computer. 
     YarraDigital.com is an Australian website and is subject to Australian law.Yarra Digital may be required by law to disclose Personal Information to proper law enforcement authorities, even though you might have requested that we don't share your information. This information may be necessary to identify, contact or bring legal action against anyone who may attempt to cause injury to another's rights or property.
